Please read these Terms of Service ("Terms") carefully before using the services provided by Digitech Infra. By accessing our website or engaging our services (Development, Infrastructure, Marketing, Training), you agree to be bound by these Terms.
1. Services Provided
Digitech Infra provides the following services:
- IT Infrastructure: Managed IT, server setup, structured cabling, and DevOps.
- Software Development: Custom web, mobile app, and software development.
- Digital Marketing: SEO, social media marketing, and branding.
- Training: Corporate and technical training via our Learning Management System (LMS).
2. Acceptable Use
You agree not to use our services for any unlawful purpose or any purpose prohibited under this clause. You agree not to use our services to:
- Host or transmit any content that is illegal, harmful, threatening, abusive, or defamatory.
- Violate the intellectual property rights of others.
- Distribute viruses, malware, or any other harmful computer code.
- Attempt to gain unauthorized access to our computer systems (hacking).
Suspension: We reserve the right to suspend or terminate your access to our services (including hosting and billing accounts) immediately if you violate these policies.
3. Intellectual Property Rights
- Client Ownership: Upon full payment, you (the Client) own the specific deliverables created for you (e.g., the custom code of your website, your logo design).
- Company Ownership: Digitech Infra retains ownership of all background technology, pre-existing code, generic libraries, and our own "Digitech Infra" branding and tools used to create the deliverables.
- License: You grant us a non-exclusive license to use your materials (content, logos) solely for the purpose of providing the agreed services to you.
4. Payment and Billing

Invoicing: Services are billed as per the specific proposal or subscription plan selected on billing.digitechinfra.com.

Payment Terms: Invoices are due upon receipt unless otherwise specified. Recurring services (Managed IT, Hosting) are billed in advance.

Refunds:
- Hosting/Subscriptions: Generally non-refundable after the first 30 days.
- Custom Development: Non-refundable once work has commenced.
- Training: Refundable only if the course is cancelled by Digitech Infra.

Late Fees: We reserve the right to charge a late fee on overdue invoices or suspend services until payment is made.
5. Disclaimers and Limitation of Liability
- No Warranty: Services are provided "as is" and "as available." We do not warrant that our services will be uninterrupted, error-free, or completely secure.
- Marketing Results: For Digital Marketing/SEO services, we do not guarantee specific search engine rankings or sales numbers, as these depend on third-party platforms (Google, Facebook).
- Liability Cap: In no event shall Digitech Infra be liable for any indirect, incidental, special, or consequential damages (including loss of data or profits). Our total liability for any claim arising out of these terms shall not exceed the amount paid by you to us in the three (3) months preceding the claim.
6. Third-Party Services
Our services may integrate with third-party tools (e.g., AWS, Azure, Google Cloud). You agree to comply with the terms of service of these third-party providers. We are not responsible for any downtime or data loss caused by third-party providers.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, USA, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Maryland.
